Tender Description

The Department of Finance (Finance) is establishing a Whole of Australian Government (WoAG) Panel for Recruitment and Search, Labour Hire and Contractor Services collectively referred to as the People Panel.

The People Panel will be established through a series of coordinated procurements, undertaken in phases with each phase conducted through separate open approaches to market.

The third phase in the People Panel series, this Request for Tender (RFT), is for Professional Contractor Services only (Professional Contractor Services Panel).

Professional Contractor Services refer to resources engaged through a procurement process (excluding ‘consultants’ as defined in RMG423, and outsourced service provider arrangements), and are not inclusive of ongoing or non-ongoing staff employed under the Public Service Act.

A Professional Contractor means a person who:

  • is an expert with extensive knowledge an experience in the Service Area and Service Category to which the Ordered Services relate and is the Service Provider (if the Service Provider a sole trader) or the employee of the Service Provider (or the natural person otherwise engaged directly by the Service provider).
  • the Professional Contractor is not an employee of the Entity. The Professional Contractor will work under the supervision, direction and control of the Entity, (as described in clause 19.6.1 of Attachment C - Head Agreement) and at the premises of the Entity or another location as described and required under the terms of this Head Agreement and any Contract made under the terms of the Head Agreement.

Professional Contractors:

  • are not contingent workers – i.e. labour hire for APS equivalent roles is out of scope
  • have hourly rates that are negotiated by reference to prevailing industry hourly rates i.e. not aligned to APS classifications
  • may create deliverables/tasks, but those deliverables/tasks do not represent the independent view of the service provider; and
  • hold requisite qualifications and licenses in their chosen field of work, and bring relevant industry experience to the role.

The Professional Contractor Services Panel is anticipated to commence by Quarter 4 2024/2025, for an initial four (4) year term with an option for Finance to extend the Head Agreement (at its sole discretion) for further period or periods of up to four years in total.

In accordance with clause 8.5.4 of the RFT, hyperlinked material will not be considered by Finance.
